The digital content offered for sale and purchased on the Website is offered and sold by Plastic Consult S.r.l., a company with its registered office at Milano \u2013 20151, Via Aniene n.2, VAT Registration Number IT04441680156.<\/span><\/p><p><span style=\"font-weight: 400;\">The Website is owned by Plastic Consult S.r.l., which is also the owner of the domain name.<\/span><\/p><p><span style=\"font-weight: 400;\">Plastic Consult S.r.l. is the sole contracting party of the user intending to purchase one or more Services via the Website and is therefore:<\/span><\/p><ol><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the entity to which the user addresses their order to accept the offer and conclude the contract of sale;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the entity that assumes pre-contractual obligations towards the user arising from the offer;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the entity that concludes the contract of sale with the user, assuming the relevant rights and obligations.<\/span><\/li><\/ol><p><span style=\"font-weight: 400;\">The purchase contract concluded via the Website is therefore entered into between the user and Plastic Consult S.r.l.<\/span><\/p><p><b>2) Scope of Application \u2013 B2B Relations<\/b><\/p><p><span style=\"font-weight: 400;\">These General Terms and Conditions of Sale (<\/span><b>&#8220;GTCS&#8221;<\/b><span style=\"font-weight: 400;\">) govern the sale of products and services exclusively to entities purchasing in their capacity as professionals, businesses, or VAT registration holders.<\/span><\/p><p><span style=\"font-weight: 400;\">Therefore, the following are expressly excluded from the scope of application:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Italian Consumer Code (Legislative Decree 206\/2005);<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The regulations regarding the right of withdrawal (cooling-off period) provided for consumers.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">By submitting an order, the Client declares that they are acting for professional purposes.<\/span><\/p><p><b>3) Subject Matter of the Contract<\/b><\/p><p><span style=\"font-weight: 400;\">The Seller markets, via the website, digital content and professional services, such as, by way of example:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">market studies and analysis reports;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">digital documents, white papers, and research papers.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">The products are supplied in digital format via download, online access, or sent via email.<\/span><\/p><p><b>4) Pre-contractual Information<\/b><\/p><p><span style=\"font-weight: 400;\">Prior to purchase, the Client may review:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the description of the products\/services;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the total price;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the payment methods;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the methods of access or supply;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">these GTCS;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the privacy policy and cookie policy.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">The submission of an order implies full knowledge and acceptance of these GTCS.<\/span><\/p><p><b>5) Purchase Procedure and Conclusion of the Contract<\/b><\/p><p><span style=\"font-weight: 400;\">The purchase is made through an electronic procedure that allows the Client to:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">select the product or service;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">view an order summary;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">accept the General Terms and Conditions of Sale;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">proceed to payment.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">The contract is deemed concluded upon the submission of the order via a button clearly indicating the obligation to pay.<\/span><\/p><p><b>6) Pricing and Invoicing<\/b><\/p><p><span style=\"font-weight: 400;\">Prices are expressed in Euros (\u20ac) and are exclusive of VAT, unless otherwise specified. The invoice is issued based on the data provided by the Client. The Client is solely responsible for the accuracy and completeness of the invoicing data.<\/span><\/p><p><b>7) Payment Methods and Security<\/b><\/p><p><span style=\"font-weight: 400;\">The Seller accepts the payment methods indicated on the website, including:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">credit cards from major networks;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">debit cards, where enabled;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">any additional electronic payment instruments.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">The charge is made at the time of order confirmation, unless otherwise specified. Payment data:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">is encrypted;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">is transmitted directly to the payment gateway provider;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">does not pass through, nor is it stored on, the Seller\u2019s servers.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Any storage of payment data is managed exclusively by the provider and may be revoked by the Client at any time.<\/span><\/p><p><b>8) Supply of Digital Content<\/b><\/p><p><span style=\"font-weight: 400;\">Digital content is made available as indicated in the product description sheet, for example:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">immediate download after payment;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">access to an online platform;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">delivery via email.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">The Client is responsible for ensuring they possess suitable technical equipment to access and use the content.<\/span><\/p><p><b>9) Exclusion of the Right of Withdrawal and Refunds<\/b><\/p><p><span style=\"font-weight: 400;\">As these contracts are concluded between professionals:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">no right of withdrawal applies;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the execution of the contract begins immediately after payment;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">no cancellations or refunds are permitted, unless otherwise agreed in writing.<\/span><\/li><\/ul><p><b>10) Legal Conformity Guarantee<\/b><\/p><p><span style=\"font-weight: 400;\">The Legal Conformity Guarantee is reserved exclusively for users acting as consumers, meaning natural persons who purchase Services for purposes unrelated to any entrepreneurial, commercial, artisanal, or professional activity carried out. Therefore, it does not apply to B2B sales.<\/span><\/p><p><b>11) Intellectual Property and Licence for Use<\/b><\/p><p><span style=\"font-weight: 400;\">The contents are protected by intellectual property rights. The Client acquires a non-exclusive, non-transferable, and limited licence for use, solely for internal professional purposes. Any form of the following is prohibited without the written authorisation of the Seller:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">reproduction;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">distribution;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">communication to third parties;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">resale or further commercial exploitation.<\/span><\/li><\/ul><p><b>12) Data Security<\/b><\/p><p><span style=\"font-weight: 400;\">The Seller adopts appropriate technical and organisational measures to ensure the security of personal data, including:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">HTTPS connection;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">protection and backup systems;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">access control.<\/span><\/li><\/ul><p><b>13) Limitation of Liability<\/b><\/p><p><span style=\"font-weight: 400;\">The Seller does not guarantee that the contents:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">are suitable for the Client\u2019s specific objectives;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">will produce specific economic or professional results.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">In any event, the Seller&#8217;s liability is limited to the maximum extent permitted by law.<\/span><\/p><p><span style=\"font-weight: 400;\">Plastic Consult S.r.l. cannot guarantee and, therefore, does not guarantee that (i) the Website will be uninterrupted and\/or free from suspension; (ii) the Website or the server on which it is hosted is free of viruses or other harmful elements, as these constitute unforeseeable events outside the sphere of control of Plastic Consult S.r.l. The user is solely and exclusively responsible for any damage to their computer (or similar equipment, including but not limited to tablets and smartphones) or for any loss of data from the user&#8217;s computer (or similar equipment, including but not limited to tablets and smartphones) arising from interaction with the Website; therefore, it is understood that in the event of such damaging occurrences, Plastic Consult S.r.l. will not reimburse any costs for assistance, repair, or correction services.<\/span><\/p><p><span style=\"font-weight: 400;\">Plastic Consult S.r.l. shall not be liable for direct, indirect, consequential, or any other damages of any nature arising from the provision and use of the Services, except in cases of wilful misconduct or gross negligence. In any event, the liability of Plastic Consult S.r.l. towards the user shall be limited solely to the reimbursement of the amount actually paid for the Service, with the express exclusion of any further compensation, indemnity, or claim of any nature, including, but not limited to, damages for loss of profit, administrative sanctions, loss of business opportunities, business interruption, or damage to reputation.<\/span><\/p><p><b>14) Processing of Personal Data (GDPR)<\/b><\/p><p><span style=\"font-weight: 400;\">The processing of the Client&#8217;s personal data is carried out in compliance with Regulation (EU) 2016\/679 (GDPR). In particular:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">data is processed for contractual and administrative purposes (Art. 6, para. 1, point (b) of the GDPR);<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">further processing (e.g. promotional communications) takes place only if provided for and permitted;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">data may be communicated to technical providers (e.g. hosting, payment platforms) appointed as Data Processors pursuant to Art. 28 of the GDPR.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Full information on data processing is contained in the Privacy Policy available on the website.<\/span><\/p><p><b>15) Customer Support and Complaints<\/b><\/p><p><span style=\"font-weight: 400;\">It is possible to request information, send communications, or lodge complaints by contacting customer services via:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Email, at the address:\u00a0<\/span><b>info@plasticconsult.it<\/b><\/li><\/ul><p><b>16) Applicable Law and Jurisdiction<\/b><\/p><p><span style=\"font-weight: 400;\">The purchase contract concluded through the Website is governed by Italian law. For professional users, the Court of Milan shall have exclusive jurisdiction over any dispute relating to the application, execution, and interpretation of these GTCS.<\/span><\/p><p><b>Unfair Contract Terms (Articles 1341\u20131342 of the Italian Civil Code)<\/b><\/p><p><span style=\"font-weight: 400;\">The Client declares that they specifically approve the clauses relating to:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">exclusion of the right of withdrawal (Art. 9);<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Intellectual Property and licence for use (Art. 11);<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">limitations of liability (Art. 13);<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">competent jurisdiction (Art. 16).<\/span><\/li><\/ul><p><b>APPOINTMENT AS DATA PROCESSOR pursuant to Art. 28 of the GDPR (EU Reg. 679\/2016 on the protection of personal data)<\/b><\/p><p><span style=\"font-weight: 400;\">By accepting these General Terms and Conditions of Sale and Terms of Use, the user (Data Controller) who has decided to install the &#8220;cookie banner&#8221; managed by\u00a0________\u00a0hereby appoints the latter, pursuant to Art. 28 of the GDPR, as the Data Processor for the personal data of the users of the Data Controller&#8217;s own website (Data Processor).<\/span><\/p><p><span style=\"font-weight: 400;\">The categories of personal data whose processing is delegated to the Data Processor are as follows: IP addresses of the users of the Data Controller&#8217;s website who have interacted with the cookie banner.<\/span><\/p><p><span style=\"font-weight: 400;\">The appointment as Data Processor takes effect from the acceptance of these General Terms and Conditions of Sale and Terms of Use and for the entire duration of the service offered by the Data Processor; therefore, upon termination of the effects of the General Terms and Conditions of Sale and Terms of Use, for any reason, the effects of this appointment shall also cease immediately. Confidentiality obligations and prohibitions on disclosure and\/or communication must be observed by the Data Processor even after the termination of the General Terms and Conditions of Sale and Terms of Use.<\/span><\/p><p><span style=\"font-weight: 400;\">The Data Processor undertakes to process personal data solely for the purposes of the correct execution of the General Terms and Conditions of Sale and Terms of Use and consequently:<\/span><\/p><ol><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">to process Personal Data in accordance with any documented instructions from the Data Controller;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">to inform the Data Controller of any request and\/or communication relating to personal data received from the Italian Data Protection Authority or from any other competent authority, whether Italian or foreign, in matters of personal data protection.<\/span><\/li><\/ol><p><span style=\"font-weight: 400;\">Personal data processed by the Data Processor will be deleted upon termination of the contract with the Data Controller and, in any event, within 10 years from the cessation of the contractual relationship.
